These Terms of Service (“Terms”) govern your use of the MihiraCare AI mobile application and related services (the “App”), operated by Spot Sphere Services Private Limited (“MihiraCare”, “we”, “us”). By creating an account or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
You must be at least 18 years old and able to form a binding contract to use the App. By using the App you represent that you meet these requirements and that the information you provide is accurate.
The App supports patient, doctor, family/guardian and hospital roles. You are responsible for keeping your login credentials secure and for all activity under your account. Doctors, guardians and hospitals confirm they are authorised to access the patient information made available to them through the linking codes they use. Notify us promptly of any unauthorised use.
If you use the App as a doctor or hospital, you remain solely responsible for your clinical judgement and for compliance with your professional and legal obligations. Summaries, checklists and alerts generated by the App (including AI-generated content) are informational aids only and do not constitute clinical direction. You are responsible for verifying information before acting on it.
The App is free for patients, doctors and guardians. Hospitals purchase patient “seats” through their in-app hospital profile; one seat allows one patient connection within that hospital. Seat purchases are billed to the hospital and are business-to-business transactions. Fees, taxes (including GST) and any refunds are as described at the time of purchase. We may change pricing on prospective notice.
Mira uses third-party AI models (Anthropic Claude via Amazon Bedrock) to assist with logging, factual summaries of your own data, translation, and reading documents you upload. AI output may be inaccurate or incomplete and must not be treated as medical advice. You are responsible for reviewing AI-assisted content before relying on it.
You agree not to: (a) use the App unlawfully or to harm others; (b) attempt to access data you are not authorised to access; (c) reverse engineer, disrupt, or overload the service; (d) upload malicious code or content that infringes others’ rights; or (e) use the App to provide services to third parties without our permission.
The App, including its software, design, branding (“MihiraCare AI”, “Mira”) and content we provide, is owned by MihiraCare and its licensors and is protected by law. You receive a limited, non-exclusive, non-transferable licence to use the App under these Terms. You retain rights to the content you submit and grant us the licence necessary to operate the service for you.
The App relies on third-party infrastructure (including Amazon Web Services). We are not responsible for third-party services’ own acts or outages, though we choose reputable providers and bind them to appropriate obligations.
The App is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that AI output will be accurate. Nothing in the App is medical advice.
To the maximum extent permitted by law, MihiraCare and its affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from reliance on AI output or on the App for medical decisions. Our total liability for any claim relating to the App will not exceed the amount you paid us (if any) in the 12 months before the claim.
You agree to indemnify MihiraCare against claims arising from your misuse of the App, your breach of these Terms, or your violation of law or the rights of others.
You may stop using the App and delete your account at any time. We may suspend or terminate access if you breach these Terms or if necessary to protect users or comply with law. Provisions that by their nature should survive termination (e.g., IP, disclaimers, liability) will survive.
These Terms are governed by the laws of India. Subject to applicable law, the courts at the place of our registered office will have jurisdiction over disputes, without prejudice to any mandatory consumer-protection rights you have.
We may update these Terms. We will post the updated version with a new date and, where appropriate, notify you in the App. Continued use after changes means you accept the updated Terms.
